·        Videos have to feature XTM trucks or buggies only. 

·        Keep ‘em under 5 minutes.         

·        Don’t show anything dangerous, violent or illegal.      

·        Keep it family friendly.

·        You need to own the rights to post your video – don’t use copyrighted materials unless you have permission.       

·        We reserve the right to reject any submission.        

·        Post your video on YouTube and RCUniverseVideo, email us the links, and we send you a confirmation – once you receive this your entry is official. Official e-mail for entry is xtmcontest@globalhobby.net       

·        You have to e-mail us with the link before midnight PST July 31, 2007 to qualify.      

·        Sorry but contest is only open to persons residing in the USA.         

·        Winner will be notified by e-mail 30 days after the end of the contest. 

·        Winners are chosen by XTM staff and judging is completely subjective and probably irrational.        

·        Grand prize – Craig’s MMT. If you think Craig is overrated and want to build your own beast you can opt for $500 worth of other XTM stuff.

XTM RACING MMT VIDEO CONTEST
OFFICIAL RULES

1. ELIGIBILITY: Open to legal U.S. residents (except where prohibited) who are above the age of majority in the state in which they reside at time of entry and who have Internet access as of April 20, 2007. Employees, officers and directors of Global Hobby Distributors, ("Sponsor"), XTM Racing ("XTM"), their subsidiaries, affiliates, advertising agencies, promotional suppliers, and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such individuals (collectively, "Contest Entities") are not eligible. All applicable federal, state, and local rules apply. VOID IN PUERTO RICO AND WHERE PROHIBITED OR RESTRICTED BY LAW.
2. CONTEST DESCRIPTION: Contest ("Contest") begins at 12:01 AM Pacific Time ("PT") on May 1, 2007 and ends at 11:59 PM PT on July 31, 2007 ("Contest Period"), and provides entrants an opportunity to share video of XTM trucks and buggies in action. Entries may be submitted between the dates of May 1, 2007 at 12:01 AM PT and July 31, 2007 at 11:59 PM PT. A Contest entry shall consist of an e-mail sent to xtmcontest@globalhobby.net with full name address age and link to an Original Video Submission, together with an Original Video Submission An Original Video Submission is an original expression, in audio-visual form, made by the entrant of the entrant's ideas, language, content, images, text, graphics, animation, music and/or other materials, highlighting an XTM truck or buggy in action. The Original Video Submission must be (i) in digital format that meets the requirements for upload specified in Section 3 of these Official Rules and at the Contest Website, (ii) no longer than 5 minutes in length, and (iii) constitute original work and the sole and exclusive property of the entrant over and to which the entrant has all exclusive rights. Entries must be submitted in English and may not use any commercial copyrighted music or images. If anyone other than the entrant appears in the Original Video Submission, the entrant must know the names and addresses of all identifiable persons and must have written permission from those persons to submit the Original Video Submission to Contest Entities.
3. TO ENTER: NO PURCHASE NECESSARY. Send the entry e-mail with the requested information, including your name, email address and date of birth, and follow the directions to upload your video. The video may not exceed 5 minutes in length and must be uploadable to YouTube and RCUniverse.com. You may enter as often as you wish, but each Original Video Submission must be unique, must meet all entry requirements and must be submitted separately.
4. CONDITIONS ON ENTRY. By submitting an entry, you grant permission, without limitation, for your Original Video Submission to be displayed online. Further, by entering you warrant and represent that your Original Video Submission is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your entry materials and Original Video Submission (including, without limitation, the rights to any persons appearing in the Original Video Submission or any photographs, music or video clips included in the Original Video Submission) and that your Original Video Submission does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an Original Video Submission that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take against you.
   
   Entrants grant the Sponsor all rights of ownership, reproduction, and use of entries, including the Original Video Submission, for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use, and without compensation to the entrant. By entering the Contest, each entrant waives any and all rights he or she may have to the Original Video Submission. To the extent entrant has any rights in the Original Video Submission, the entrant assigns all such rights to the Sponsor by entering the Contest.
   
   Entries, including the Original Video Submission, may not defame or invade the rights of publicity or privacy of any person, living or deceased, or otherwise infringe upon a person's personal or proprietary rights. Original Video Submissions that are deemed by the judges in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor's image will be disqualified. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor's reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules. Other than for submission acknowledgement and winner notification, neither Sponsor, nor anyone acting on its behalf, will enter into any communication with any entrant regarding this Contest.
5. JUDGING: The winner will be selected by a panel of judges selected by XTM.  The potential Grand Prize winner will be notified on or about August 30, 2007 by email. Odds of winning depend on the number of eligible entries received and the skill of the entrants in creating their Original Video Submissions.
6. GRAND PRIZE: One Grand Prize will be awarded, consisting of one XTM MMT Radio Controlled Truck or $500 (retail value) of XTM merchandise. If a potential Grand Prize winner is found to be ineligible or not in compliance with these Official Rules or cannot accept the terms and conditions of being a Grand Prize winner, where lawful, the next highest judged contestant will be selected.
   
   Grand Prize winner agrees to grant Sponsor all rights in the Original Video Submission in all media, including the right to use the results and proceeds with the right for the full period of copyright, including all extensions and renewals thereof, and thereafter in perpetuity, throughout the world, to use and reuse all or any part of the Materials for the purpose of making and producing web or television advertising and other works, and advertising, publicizing and exploiting the same, by all means, in any manner, and in all media, whether now known or hereafter devised, and to authorize others to do so. Neither the Grand Prize winner nor any other party now or hereafter having an interest in the Materials shall have any right or action against the Sponsor or any other party arising out of any use of said Materials. The Grand Prize winner further agree that the Sponsor may elect, in its sole discretion, not to use the Materials, or to use only a portion of the Materials. Prize is non-transferable and cannot be substituted, except by Sponsor, in its sole discretion.
7. GENERAL: All taxes on prize and all expenses related to acceptance and use of the prize not specified are the sole responsibility of Grand Prize winner. By participating, entrants agree: [a] to these rules and decisions of Sponsor and Contest Administrator, which shall be final in all respects relating to the Contest; and [b] to release, discharge and hold harmless Contest Entities from any and all injuries, liability, losses and damages of any kind resulting from their participating in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy. Entrants agree to grant Sponsor: [a] all rights of ownership, reproduction and use of entry, including the Original Video Submission, for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use; and if a winner, [b] to permit Sweepstakes Entities to use his or her name, photograph, likeness, Contest entry, Original Video Submission, biographical information, voice, voice likeness, and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to within Sponsor's website, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Contest Entities are not responsible for and shall not be liable for: [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures in all or any parts of the United States; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted. Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and to award the prize from all eligible entries received prior to such action taking place. No prize transfer or cash redemption. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor in which case a prize of comparable or greater value will be awarded. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Any person who enters by any of the methods described above will be disqualified. Use of any device to automate entry is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry at any time in the event it is determined that the Entrant has not complied with these Official Rules. This Contest is governed by the laws of the State of California with jurisdiction and venue in Orange County, California, and all claims must be resolved in the courts of Orange County, California.
